JDK Systems Doing Business Policy
In today's business world, problems sometime arise.
Below is
JDK System's company policies.
DATA LOSS
Requested installation and/or repair service may cause partial or complete data loss from my equipment. I must maintain backups of my data. I assume all responsibility for restoring any lost data or software. I understand that JDK Systems assumes no responsibility for any software program, data loss, or data restoration.
ACCEPTANCE OF ORDER / SHIPPING
All sales and service is subject to credit approval of my credit in JDK Systems’ sole discretion. Cost of shipping shall be charged to me.
WARRANTY REPAIRS
I understand that software, software configurations, Virus detection/removal, plastic parts, and some hardware adjustments are not covered by manufacturers’ warranties and that normal Non-Warranty repair rates will apply.
NON-WARRANTY REPAIRS
A diagnostic fee equal to one hour labor is due for examining the unit, diagnosing the problem, and/or testing of the equipment or part. This fee is due if any portion of this service is provided. However, this fee will be waived if I choose to have JDK Systems perform Non-Warranty repairs or installation on the equipment or part. Hourly labor charges will apply at normal, specified rates. I understand that payment in full is due before any equipment or part can be released by JDK Systems.
SALES TERMS
Full payment is due before equipment or part is released by JDK Systems. A $35.00 late fee applies to all equipment or parts not picked up within 30 days of first notification. If invoiced, sales terms are net 15 and payments received 20 days after invoice date incur a
2% per month charge.
RETURN OF PURCHASED EQUIPMENT / PARTS
Equipment or parts purchased from JDK Systems may be returned by me within 10 days from the date of purchase. Credit for returns shall be to a purchase account or credit card, subject to a 20% restocking fee and any freight charges. No cash refunds.
PARTS FOR REPAIR
New, used, reconditioned, or re-manufactured parts may be used in warranty and non-warranty repairs.
DEPOSIT FOR CORE PARTS
I am required to submit a deposit for all core parts that I purchase. The deposit will be returned if I return the core parts to JDK Systems.
NON-RETURN OF PARTS
All warranty and non-warranty parts replaced under an exchange or core basis will not be returned to me, unless I request them in writing in advance.
UNCLAIMED EQUIPMENT / PARTS
I grant JKD Systems a security interest in and to the equipment or parts to secure payment of the charges I incur hereunder. Any equipment or parts not claimed and not paid for within 30 days of my declining repair or JDK Systems’ first notification that the work is complete shall be considered abandoned by me. I authorize JDK Systems to dispose of this abandoned equipment and parts including all data and programs.
LIMITED WARRANTY
JDK Systems provides no warranty on equipment or parts of any kind (original, replaced, new, used, etc.). Equipment and parts may or may not be covered by a manufacturer’s warranty. Repair and any installation labor is warranted by JDK Systems for 90 days from date-of-purchase and limited to a redo of original work. Determination of warranty coverage is the sole discretion of JDK Systems.
THIS LIMITED WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE.
LIMIT OF LIABILITY
In no event shall JDK Systems be liable for any consequential or incidental damages due to lost data/programs, down time, peripheral equipment damage, loss of productivity, defects in equipment, parts, or labor, or any other cause. The total liability of JDK Systems shall in no event exceed the total sum paid to JDK Systems for this repair, installation, or sale. I acknowledge that the estimated and actual fees for services provided by JDK Systems reflect this limitation of liability and allocation of risk.
INTERNATIONAL SHIPPING
It is JDK Systems policy to ship to US domestic addresses
only.
No International Shipping.
LATE FEES and RETURNED CHECKS
A late payment fee will be charged after a payment is one
week late. The fee will be charged monthly at the rate of 2%
of the outstanding balance, including any previous late
fees.
A $35.00 fee will be
charged for all returned checks.
ADDITIONAL TERMS
The above Terms and Conditions constitute the entire agreement between the parties. No amendment to or modification of this agreement will be binding unless it is in writing and signed by an authorized Manager of JDK Systems.
